Nonpayment of rent. The 3-Day Notice under Florida Statute 83.56 must state the exact amount of rent owed, nothing more. In Hialeah's cash-heavy rental market, ledger accuracy is the detail that wins or loses these cases: partial payments, cash payments without receipts, and side agreements all become ammunition for a tenant's defense if the notice amount is wrong. We build the notice from a clean ledger before anything gets served.
Efficiencies and converted units. Disclose the unit’s legal use, permits, occupancy arrangement and any code-enforcement notices. Those facts can affect the claim and defenses; we assess them before recommending an action.
Residential month-to-month termination. Section 83.57(3) requires at least 30 days’ written notice before the end of a monthly rental period. Confirm the rental-period dates, lease and any additional housing requirements before service.
Family and unauthorized occupants. A missing written lease does not by itself make an occupant an unlawful-detainer defendant. Review rent payments, oral agreements, permission to occupy and any ownership claim. A landlord-tenant eviction under Chapter 83, unlawful detainer under Chapter 82 and ejectment are different actions. Compare unlawful detainer and eviction.
Unclear occupancy status. Provide the history of possession, permission, rent payments and any ownership claim. The label “squatter” alone does not establish which remedy or procedure applies.
There is no guaranteed completion date. Timing depends on the required notice, service of the summons, the tenant’s response, any court-registry issues, the court’s calendar, and the sheriff’s availability. We explain the next procedural step after reviewing the case documents.
In a residential possession action, section 83.60(2) generally requires the tenant to deposit accrued rent alleged in the complaint, or file a properly supported motion to determine rent, within five days after service of process, excluding Saturdays, Sundays and legal holidays. The payment defense and other statutory qualifications must be considered; subsidized tenants deposit only their required portion. Rent that becomes due must also be addressed. We review service, filings and court orders before requesting relief; a missed deposit is not permission for self-help removal.
The ledger and your documentation control. This is exactly why the 3-Day Notice amount has to be built carefully before service: a wrong amount gives the tenant a defense. Going forward, give receipts for every cash payment; in the current case, we work with the records that exist.
Tell us whether the unit is a converted efficiency, its permitted use and any code notices. Counsel must assess the tenancy, potential defenses and available remedy before confirming whether and how to proceed.
A written lease is not required for every tenancy. For a residential month-to-month termination, section 83.57(3) generally requires at least 30 days’ written notice before the end of the monthly rental period. Nonpayment and other grounds use different requirements; confirm the actual arrangement first.
Our flat fee covers eviction filing through final judgment, including motions and hearings within the agreed matter. Notice preparation and posting are one separate service. Sheriff/writ work is one separate service and charge. Work beyond the agreed scope is separately confirmed in writing. Before work begins, we confirm the fee and how court filing, summons and service costs are treated in writing.
Spanish-language intake and client communication are available. Court filings, interpretation and hearing arrangements must follow the court’s requirements; we do not promise that every court proceeding will be conducted in Spanish.
