## Eviction Process in Miami-Dade County Court

**Notice:** The legally required written notice is served on the tenant. For nonpayment, the 3-Day Notice must state the exact amount owed and allow three business days (excluding weekends and legal holidays) for payment or vacatur.

**Complaint:** After the notice period expires without compliance, the eviction complaint and summons are filed in Miami-Dade County Court at the Eleventh Judicial Circuit. Filing fees are paid at the time of filing.

**Service:** The Miami-Dade Sheriff's Office or a certified process server serves the summons and complaint on the tenant. The tenant has five business days from the date of service to file a written response.

**Default or Hearing:** If the tenant does not respond within five business days, a motion for default judgment is filed. If the tenant responds, the court schedules a hearing. In residential cases, the tenant must deposit the rent claimed in the complaint into the court registry or risk having their defenses struck under Florida Statute 83.60.

**Judgment and Writ:** After a judgment for possession is entered, the clerk issues a Writ of Possession. The Miami-Dade Sheriff posts the writ on the property. The tenant has 24 hours to vacate. If the tenant remains after 24 hours, the sheriff physically removes the occupants.
